Welcome to GymWalls. These Terms of Service ("Terms") govern your use of the GymWalls mobile application and related services ("GymWalls," the "app," "we," "us," or "our"), which provides fitness and gym-themed wallpapers for your device. By downloading, accessing, or using GymWalls, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the app.
1. Acceptance of Terms
You must comply with these Terms, all applicable laws, and any rules that apply to the app store or platform from which you downloaded GymWalls, including Apple's App Store Terms and Conditions when using the iOS version of the app.
2. License and Use of the App
GymWalls is licensed, not sold, to you for personal, non-commercial use. We grant you a limited, revocable, non-exclusive, non-transferable license to install and use the app on devices that you own or control, and as otherwise permitted by the applicable app store terms. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or attempt to extract the source code of the app, except where applicable law expressly allows it.
For the iOS version, your license is limited to use on Apple-branded products that you own or control and as permitted by Apple's Media Services Terms and Conditions, including Family Sharing or volume purchasing where applicable.
3. Intellectual Property Rights
All content within GymWalls, including wallpapers, images, designs, logos, names, text, software, and related materials, is owned by GymWalls or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may use wallpapers made available through the app for personal device wallpaper purposes. You may not reproduce, redistribute, resell, upload, sublicense, or create derivative commercial works from app content without our written permission.
4. Prohibited Conduct
When using GymWalls, you agree not to:
- Engage in any illegal activities.
- Reverse engineer, decompile, or attempt to extract the source code of the app.
- Upload or transmit viruses, malware, or any other destructive code.
- Interfere with or disrupt the app's security or functionality.
- Use the app for any commercial or advertising purposes.
5. In-App Purchases and Subscriptions
If GymWalls offers paid downloads, in-app purchases, subscriptions, premium content, or other paid features, payment and billing will be handled by the app store provider, such as Apple for iOS purchases. Purchases may be subject to that provider's payment, refund, renewal, cancellation, and tax terms. We do not control app store billing systems and cannot issue refunds that must be processed by the applicable app store.
6. Third-Party Services
GymWalls may use third-party services to host content, process diagnostics, provide app platform features, or support app functionality. Your use of third-party services may be subject to their own terms and policies.
7. Apple App Store Terms
If you downloaded GymWalls from the Apple App Store, you acknowledge and agree that these Terms are between you and GymWalls, not Apple. Apple is not responsible for GymWalls or its content.
We are solely responsible for providing maintenance and support for GymWalls as described in these Terms or as required by applicable law. Apple has no obligation to provide maintenance or support services for the app.
If GymWalls fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app, if any, as required by Apple's terms. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to GymWalls. Any other claims, losses, liabilities, damages, costs, or expenses related to a warranty failure are our responsibility to the extent required by applicable law.
We, not Apple, are responsible for addressing claims relating to GymWalls, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer protection, privacy, or similar laws. If a third party claims that GymWalls or your use of the app infringes that third party's intellectual property rights, we, not Apple, will be responsible for investigating, defending, settling, and discharging that claim to the extent required by these Terms and applicable law.
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
8. Disclaimer of Warranties
GymWalls is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy or completeness of the app's content. We do not guarantee that the app will be free from errors, viruses, or interruptions. You assume full responsibility for your use of the app and any consequences arising from that use.
9. Limitation of Liability
To the fullest extent permitted by law, GymWalls and its affiliates, directors, officers, employees, and agents will not be liable for any damages arising from your use of the app, including but not limited to direct, indirect, incidental, consequential, or punitive damages.
10. Modifications to the App and Terms
We reserve the right to modify or discontinue, temporarily or permanently, GymWalls or any features within the app, with or without notice. Additionally, we may update these Terms from time to time. Any changes will be reflected on this page, and the "Last Updated" date will be revised. Your continued use of the app after changes indicates acceptance of the new Terms.
11. Termination
We reserve the right to suspend or terminate your access to GymWalls at our sole discretion, without notice, if we believe you have violated these Terms or engaged in prohibited conduct. Upon termination, all rights granted to you under these Terms will cease.
